Terms of service

These terms govern the sale of our products through this store. Please read them before ordering. Nothing here affects the statutory rights you have as a consumer.

Who we are

What these terms cover

They cover every order placed through this store, together with our shipping policy, refund policy and privacy policy, which form part of the agreement. By ordering you accept them. If you buy as a business rather than as a consumer, the consumer-only protections below do not apply and the limits on our liability apply in full.

Ordering and acceptance

Your order is an offer to buy. The confirmation email is an acknowledgement, not an acceptance: the contract is formed when we email to say the parcel has been dispatched. Until then we may decline and refund in full — if the item is unavailable, if the price or description was clearly wrong, if we suspect fraud, if we cannot ship to your country, or if your personalisation breaks the rules below.

You may change or cancel an order while it is still at the bench, usually a window of a few hours. After that, a return is the simpler route.

Prices and taxes

Prices are shown in US dollars and include the taxes stated at checkout. Delivery is added separately and is free on orders over $50. Orders to the United Kingdom and the European Union are sent duties paid. Elsewhere, customs duties and import taxes are set by the destination country, payable by the recipient and outside our control.

We may change prices at any time, but never after a contract is formed: the price that applies is the one shown when you ordered. If a price is obviously wrong and you could reasonably have spotted it, we are not obliged to sell at it, and we will tell you before doing anything.

Availability

The pens are made in small batches, so stock moves. If something is unavailable we tell you promptly, offer an alternative or a wait, and refund if neither suits.

Payment

Payment is taken when you order, through Shopify's secure checkout: the usual cards, plus Apple Pay, Shop Pay and PayPal. We never see or store your card details. If a payment is later reversed, we may suspend the order until it is settled.

Personalisation

You may ask us to print a line and load it into the pen before it ships, or to engrave the clip where the finish allows. Two things follow.

  • You warrant that the text is yours to use. By submitting it you confirm that you hold the necessary rights, or have permission, and that printing it infringes nobody's copyright, trade mark or privacy.
  • The text must be lawful. We will not print or engrave anything unlawful, hateful, discriminatory, threatening, harassing, obscene, or intended to impersonate or defame someone. That judgement is ours to make.

Where we refuse, we write to you first and offer either a different line or a full refund. We reproduce exactly what you type, spelling and punctuation included, so read it back before you order. Engraving adds one working day. Personalised items cannot be returned unless faulty or wrongly made — see the refund policy.

Delivery and risk

Orders leave the workshop within 48 hours, Monday to Friday, tracked the whole way. The delivery times on the shipping page are estimates in working days, not guarantees. Risk passes to you when the parcel is delivered to the address you gave, including to a neighbour or a nominated safe place. Ownership passes once payment is received in full.

Returns and cancellation

You have thirty days from delivery to change your mind, and consumers in the European Union and the United Kingdom have a separate statutory right to cancel within fourteen days. Both are set out in our refund policy.

Warranty

We warrant the pen and printer against manufacturing defects for two years from delivery, covering the twist mechanism, the anodised shell and the printer battery. The remedy is repair, replacement or refund, at our choice, and we pay the postage. It does not cover accidental damage, submersion, ordinary wear, consumables such as cartridges and paper, or scrolls faded by sunlight. Your legal guarantee of conformity is unaffected.

Using the app

The companion app is free, and we grant you a personal, non-exclusive, revocable licence to use it. It is provided as it is, and Bluetooth printing needs a browser that supports Web Bluetooth. Your cards live in your browser's storage on your own device, so we cannot recover them if the device is lost, the browser data is cleared or the app is uninstalled. Use Export JSON to keep a backup. We may change or withdraw features, and we are not liable for cards you lose.

Intellectual property

The name SneakPen, the designs, the photographs and the text on this site belong to us or are used with permission, and may not be reused commercially without our written agreement. The words you send us for printing remain yours: you grant us only the licence needed to produce your order, and we make no other use of them.

Our liability

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Beyond that, and except where the law says otherwise for consumers, our total liability for an order is limited to the amount you paid for it. We are not liable for indirect loss, for lost profits or business, or for the content of anything you asked us to print. If you are a consumer, we are responsible for loss that is a foreseeable result of us breaking these terms.

We are not liable for delay caused by events outside our reasonable control: carrier disruption, customs, extreme weather, a supplier failing. If such an event lasts more than thirty days, either of us may cancel the affected order and we refund what you paid.

Suspension and termination

We may refuse service, cancel an order or close an account where these terms have been broken, where fraud is suspected, or where someone abuses our staff. Anything paid for goods not yet dispatched is refunded.

Governing law and disputes

These terms are governed by the law of [Country], and disputes may be brought before the courts of [Courts]. Consumers resident in the European Union or the United Kingdom keep the protection of the mandatory rules of their own country and may bring proceedings there. Please write to us first: most things are settled by email within a day.

General

If any clause turns out to be unenforceable, the rest stands. These terms, and the policies they refer to, are the whole agreement between us.

Changes to these terms

We may update these terms. The version that applies to your order is the one published when you placed it; the date below says which that is.
